Acceptable Use Policy (AUP)

MTel Telecommunication Company offers all kinds of related Internet services for commercial and residential users, including Internet Public Access, E-mail, Database Access and Retrieval, Web Hosting, Application Hosting and Database Hosting, WLAN, Centre, and other information and Internet related telecommunications services. AUP defines the use of service acceptance in order to ensuring the quality of service and customer privacy, and ensure the Integrity, security, reliability and privacy of MTel networks, Systems, Products, Services, Server Hosting Facilities and data contained therein. If anyone was allowed to use the service, and/or any information, or content of which, Customers must ensure that the user must comply with applicable terms and conditions of service, and/or service of information or content. Customers of MTel Telecommunication Company, who must fully responsible for the content and information that accessed, published, announced, or obtained from MTel internet by other ways.


1 .Prohibited Activities

Each of the practices listed below constitute an abuse of MTel Network interferes with other Customers, therefore are prohibited.

1) Advertising, transmitting, or otherwise making available any software, program, product, or service that violates this AUP, which includes, but is not limited to, engaging in or facilitating the means to send unsolicited commercial messages or communications in any form or unsolicited bulk email ("SPAM"), initiation of pinging, flooding, and denial of service attacks;

2) Falsifying user or other services related information, including, but not limited to, intentionally omitting, deleting, forging or misrepresenting transmission information, including header, return mailing and internet protocol address. Those are provided to MTel or to other service users or engaging in any activities or actions intended to withhold or cloak Customer's or its end users identity or contact information;

3)Engaging in any other activities, which include: 

  • -Violation of any laws or regulations, including, but not limited to, spreading of rumor, libel, slander, invasion of privacy, harassment, obscenity, pornography, and infringement or misappropriation of another party's copyright, trademark, patent, trade secret or other intellectual property rights;

  • Violation of MTel rights and interests;

  • Threat of the integrity or security of any network or computer system, including, but not limited to, transmission of virus, Trojan horse, worm, mail-bomb, keystroke logger, spyware, adware or any other harmful Computer instruction, program device or technology, which can be used of threat, infection, destruction, shutdown of any telecommunications equipment or anyone’s computer system component, or invalidation of any software, content, or other materials;

  • The purpose of harming, or attempting to harm minors in any ways;

  • Attempt to use the service in such a manner so as to avoid incurring charges or being required to pay for such usage;

  • Decrease or disturb the use of normal service of other users in other ways;

  • Violation of any legal duty owed to a third party, such as contractual duty or duty responsibility;

  • Violation of internet or other networks conduct and standard, including, but not limited to, malicious webpage modification, port and network scanning, and unauthorized system penetrations;

  • Pretense of host, sending and receiving station, as online server or transfer station without the consent of MTel;

  • Violation of pretending the use of sharing platform. (The use of service as hosting server and sharing files with other internet users);

  • Any indirect or attempted violation of this AUP by making use of the service of other providers to engage in any of the above prohibited activities, and on behalf of a Customer or a Customer's end user, and any attempted violation by a third party on behalf of a Customer or a Customer's end user, shall be considered a violation of the AUP;

4) Not allowed to show in public place: -Information or content available through the service that customers cannot allow to authorize and permit anyone to show or exhibit that in public place.


2.Rights and Remedies

If MTel determines that a Customer, its representative or its end user has breached or failed to comply with this AUP or engaged (or permitted others to engage) in a Prohibited Activity, MTel may take such actions as it deems appropriate. Including all or any of the followings:

1) Having the rights of suspending/or terminating a Customer's Service at any time;

2) Having a warning to a Customer;

3) Commencing legal proceedings against a Customer for the reimbursement of all costs resulting from the breach of this AUP (including, but not limited to, reasonable administrative and legal costs);

4) Denying all communication from known IP address blocks that support unlawful or Prohibited Activity, for the purpose of preserving customer's system and network resource;

5) Taking further legal action against the customer;

6) Notifying the related competent authority to investigate if it belongs to the illegal activity;

7) The customer must pay for all related costs when MTel has taken any actions;

If MTel receives a court order requesting MTel to provide a customer’s identity to it complaining that the customer has used the Services abusively, MTel will be entitled to do so, and will also be entitled to provide the customer’s identity or other data regarding the use of the services to the police or other public authorities if MTel is required to do so by laws.

MTel reserves the rights in feasible and legally admissible, and will take actions to prevent a prohibited activity. In addition, MTel reserves the rights to charge the customer to cover administrative costs associated with the prohibited activity of the customer including, but not limited to, recovery of the costs of identifying offender and removing them from or discontinuing providing their service, in an amount equal to MTel actual expense incurred in preventing or responding to such activity.

The clauses in this AUP do not limit MTel legal rights and remedies in any way with respect to any prohibited activities.

This AUP will not affect MTel network and provide terms of conditions of internet service.


3.Password Protection

A customer is responsible for protecting its password and for any authorized or unauthorized user made of its password. A customer must not disclose its password or use or permit anyone to use MTel service to guess password or access other systems or networks. In the event a network or network device becomes compromised, MTel may assist in the tracking and/or expulsion of such offender as the process MTel considers reasonable on the network level, at its sole and absolute discretion.

MTel reverses the rights to modify the terms and conditions of this AUP policy from time to time. Please refer to the updated information at MTel official home page. This policy shall be governed by the laws of the Macau Special Administrative Region of the People's Republic of China, and both sides completely shall be governed by Macau Special Administrative Region Court.
